Occupational Driver's License

An Occupational Driver's License (aka Essential Need License) may be issued to individuals whose drivers license has been suspended, revoked, cancelled or denied.

An Occupational Driver's License allows the operation of a motor vehicle in order to travel to work, to school, and in the performance of essential household duties. In most cases, an Occupational License allows an individual to drive up to 4 hours per day. However, a court may allow a person to drive up to 12 hours in a day upon a showing of necessity.

NOTE: An Occupational License may not be used for the operation of
a commercial vehicle.

An Occupational Driver's License may be obtained by filing a petition with (1) the Justice of the Peace, County Court at Law or District Court in the individual's county of residence, or (2) in the court of original jurisdiction where the criminal offense occurred.

If the court approves the request for an Occupational Driver's License, the court will issue a court order. The court order must be filed with DPS, which in turn will process and issue a hard copy of the Occupational Driver's License.
