Texas law requires all drivers to maintain proof of financial responsibility to pay for any accidents they may cause. Most people satisfy this requirement by purchasing vehicle liability insurance.


Failure to Maintain Financial Responsibility (aka Driving without Insurance) is a Class C misdemeanor.
The penalties for violating this law are:

  • First offense: fine of $175 to $350. DPS surcharge of $250 x 3 years.
  • Additional offenses: fine of $350 to $1,000, suspended driver's license, and impoundment of your car. DPS surcharge.
  • Offense without a DL: $2,000 maximum fine, 180 days in jail, or both. DPS surcharge.
  • Offense if you cause an accident with serious injuries or death: $4,000 maximum fine, one year in jail, or both. DPS surcharge.

DPS Driver Responsibility surcharges

A conviction for Failure to Maintain Financial Responsibility (No Insurance) will result in a DPS surcharge of $250.00 per year that will be billed for three consecutive years. Failure to pay the surcharge will result in a suspended driver's license.
